1. Agreement
By downloading, accessing, or using Under FM, you agree to these Terms & Conditions and to the Under FM Privacy Policy. If you do not agree, do not use the app.
Under FM is operated by EnterMaurs Inc (“EnterMaurs,” “we,” “us”).
2. The service
Under FM is an iOS app that plays looping background beats under other audio for personal listening. It is a focus and entertainment utility — not medical advice, therapy, or a fitness training program.
Beat content is licensed for in-app listening only. You may not redistribute, sample, rip, or re-upload loops outside the app.
3. Eligibility
- You must be at least 13 years old (or the minimum age required in your jurisdiction to accept these Terms).
- An Apple App Store account is required for purchases and subscriptions.
4. Free tier & Under FM Pro
Free: A starter set of tracks (including the first tracks in Easy / Steady / Fast) with full playback features — never intentionally degraded.
Under FM Pro: Unlocks the remaining catalog via App Store subscription or lifetime purchase.
If a free trial is offered, Apple will show the trial length and the price after the trial before you confirm. Billing starts automatically unless you cancel at least 24 hours before the trial ends.
Lifetime purchase: A one-time purchase. It is non-refundable except as required by law or Apple’s refund policies. There is no subscription to cancel for lifetime access.
5. Subscriptions & billing (Apple)
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions auto-renew unless cancelled in Apple ID settings at least 24 hours before the end of the current period.
- Manage or cancel anytime: Settings → Apple ID → Subscriptions.
- Restore Purchases is available in the app (Profile or paywall) to restore Pro on the same Apple ID.
- Prices may change with notice as permitted by App Store rules.
6. Acceptable use
You agree to use Under FM only for personal, non-commercial listening.
- No reverse engineering or attempting to extract audio assets
- No scraping the catalog or automated access
- No use that violates Apple’s App Store Review Guidelines
7. Intellectual property
EnterMaurs owns the Under FM app, branding, and the licensed beat content presented in the app (subject to third-party licenses). You receive a limited, personal, non-transferable license to listen to content in the app — not to copy, distribute, or create derivative works from the audio files.
8. Disclaimer of warranties
Under FM is provided “as is” and “as available.” To the fullest extent permitted by law, EnterMaurs disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service.
9. Limitation of liability
To the fullest extent permitted by law, EnterMaurs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of Under FM.
Our total liability for any claim relating to the app will not exceed the greater of (a) the amount you paid to EnterMaurs for Under FM in the 12 months before the claim, or (b) CAD $50 if you have not paid for the app.
10. Termination
We may suspend or terminate access if you abuse the service or violate these Terms. You may stop using Under FM at any time by deleting the app. Deleting the app does not cancel an active Apple subscription — cancel through Apple ID settings.
11. Governing law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. Courts located in Ontario have exclusive jurisdiction, except where prohibited by local consumer law.
